Express Entry is a selection system for Canadian immigration, designed to select qualified workers for immigration to Canada.

Express Entry is a completely electronic process involving the federal government, provincial governments and Canadian employers.

What is Express Entry?

In January 2015, the Canadian government launched a new electronic immigration system that offers express entry to Canada for qualified and skilled immigrants.

The new Express Entry program will manage permanent residence applications for immigrants who can work where there is a shortage of qualified Canadian workers available.

The Canadian government has recognized that Canada needs new immigrants to meet future labour market needs and help ensure the country’s long-term economic growth and prosperity.

The new system will allow Canadian Citizenship and Immigration (CIC) to proactively assess, recruit and select immigrants who are qualified and/or have appropriate qualifications under federal economic immigration programmes:

• Federal Skilled Workers Programme (FSWP)
• FSTP (Federal Skilled Trades Program)
• Canadian Experience Class (CEC)

The Express Entry Program will also allow individual Provinces and areas to use the system to recruit suitable candidates under the Provincial Appointments Programs to meet the requirements of the labour market.

Employers will play a key role in the selection of economic immigrants and will be able to access suitable candidates through the Canadian Labor Bank, which has recently been improved, as well as in the provinces and territories concerned.

Atlantic Immigration Pilot Programme (AIPP)

The Atlantic Immigration Pilot is a fast-track immigration scheme that allows employers in four of Canada’s Atlantic provinces – Nova Scotia, New Brunswick, Newfoundland and Labrador and Prince Edward Island – to hire foreigners for jobs they were unable to fill on site.

Introduced in 2017, the Federal Government and its provincial government partners aim to welcome more than 7000 newcomers and their families to the Atlantic region of Canada by 2021 under the Atlantic Immigration Pilot Programme.

The Atlantic Immigration Pilot is designed to welcome additional newcomers to Atlantic Canada to meet the needs of local employers and communities.

The three-year pilot program allows designated local employers to identify, recruit and retain global talent. The program also aims to support population growth, the development of a skilled workforce and increase the region’s employment rate.

The pilot is part of the overall development strategy for the Atlantic region, which focuses on the following five priority areas:

• Skilled labour and immigration;
• Innovation;
• Clean growth and climate change;
• Trade and investment; and -infrastructure.

Family Class

It allows Canadian citizens and permanent residents to sponsor their dependent children, parents and grandparents and their spouse or cohabitant. Canada strongly supports keeping families together whenever possible. Therefore, processing of Family Class applications is a top priority at Canadian visa offices. The purpose of the Family Immigration Class is to bring together close family members in Canada.

Spousal Sponsorship Category

The Spousal Sponsorship Program is a sub-section of the Immigration Family Class. Under this program, a Canadian citizen or permanent resident may sponsor a spouse or cohabitant for permanent residence in Canada.

Both a Canadian citizen or permanent resident (also known as the “Sponsor”) and a foreigner (the Sponsored Person) must be approved by Immigration, Refugees and Citizenship Canada (IRCC) in order for the Sponsored Person to receive a visa.

To obtain a visa under this immigration program, the sponsor and the sponsor must prove that their relationship falls into one of three categories:

• Spouse
• Common law partner
• Conjugal partner

N.B.: Canada recognizes same-sex marriages and same-sex partners may be eligible to apply under one of the three categories above, provided they meet all eligibility requirements.

Outland Sponsorship

An Outland application is usually submitted when the sponsored partner lives outside Canada. However, asylum-seekers may continue to reside in Canada and apply for Outland, and may be allowed to travel to and from Canada throughout the application process. Foreign applications are processed through a visa office serving the applicant’s country of origin or country where the applicant has been legally residing for at least one year.

Inland Sponsorship

Another potential option for Spousal/Common-Law sponsorship is an inland route. Inland sponsorship occurs when the couple is together in Canada and the foreign spouse/partner has temporary status in Canada, either as an employee, student or guest. A sponsored person may obtain a temporary work permit that allows them to work for any employer in Canada while processing a sponsorship application.

At the end of the sponsorship

Permanent residence granted under the Sponsorship of Spouses programme brings with it certain conditions which must be met:

The Sponsor is financially responsible for the Sponsored Person for three years after the Sponsored Person has obtained the right of permanent residence.

Persons who come to Canada as spouses are prohibited from sponsoring their spouse for five years after they become permanent residents of Canada
