Generally speaking, Child Support is payable by the parent with whom the children do not reside. This can be a biological parent or a person who stood in place of a parent. The Court may also compel the payment of Child Support to a Guardian of the Child with whom the children do not reside, even if that person is not a parent.
If there are two or more children and a Split Parenting arrangement exists wherein each spouse has the majority of parenting time with one or more of those children, the amount of child support payable is the difference between the amount that each spouse would otherwise pay if a child support order were sought against the other spouse (a “set – off” amount).
If each spouse exercises not less than 40% of the time with the child over the course of a year (Shared Parenting) then the Court may determine the amount of child support payable by examining:
a. the table amounts and the possible resulting set off amount;
b. the cost of shared parenting arrangements; and
c. the conditions, means, needs and other circumstances of the spouses and the child.
In many cases in Alberta, the Court will not deviate the table amount unless the parties have a true 50/50 Shared Parenting arrangement in the amount of time they parent the child. This, however is not always the case and is highly discretionary, based on the means, needs and other circumstances.
Under the Child Youth and Family Enhancement Act, the Court may compel either or both parents to pay support for a child if the child is in the care of the Director.
